Water
The public water supply is provided by the LCRA.
Wastewater
Wastewater service is provided by HCMUD # 4. The permit is for a total of 150,000 gpd. Of this, approximately 85,000 gallons per day of wastewater treatment capacity is available to serve the available property. Phase 1 of the wastewater plant, consisting of 75,000 gpd treatment capacity, is currently under construction to serve the initial phase of development in the district. The remaining 75,000 of capacity shall be added when needed. Small portions (approximately 2.5 acres on Site 1 and 9 acres on Site 2) of the property are reserved for use as sub-surface drip irrigation drain fields for the treated effluent. These areas shall be utilized for open space / non-impervious cover and do not affect the development density attainable on these sites.
Dry Utilities
Telephone service is provided by SBC, electric by PEC, gas by Texas Gas, and cable service by Time Warner. Electric, telephone, and cable must be installed underground.
Zoning
The property is located in the ETJ of the City of Dripping Springs and is not subject to any land use restrictions, building height restrictions, or other such regulations applicable to property that is located within the corporate limits of a municipality. Seller will establish certain use and architectural guidelines in conjunction with each sale.
Consent Agreement
Development of the property is enhanced by a Consent Agreement with the City of Dripping Springs. Among other things, this agreement memorializes numerous variances to the city’s current development regulations: 1) It exempts the property from moratoriums promulgated by the City of Dripping Springs, 2) it secures the “shelf life” of preliminary plans for the life of the development 3) it “locks in” development regulations (including platting and site-development permits) for the life of the development rather than their being subject to change at any time, and 4) it provides for smaller lots and less restrictive set back requirements than the current ordinance. Seller will make said agreement available to interested parties upon execution of a contract which will include a due diligence / feasibility period.
Bond Reimbursements
Because the property is located within a Municipal Utility District, certain improvements for wastewater, drainage, and water quality are partially or fully reimbursable from the District. A total of over $26 million in bonds have been authorized for purposes of reimbursing the developer(s) for these improvements.
Edwards Aquifer
The property is in the Contributing Zone of the Edwards Aquifer.
